Welcome to the Ethical Channel for communication and reporting at Artá Capital, S.G.E.I.C., S.A. (hereinafter, “Artá Capital”), which has been created in accordance with applicable regulations and serves as the company’s Internal Reporting System.

Through this Channel, you may inform Artá Capital—without fear of retaliation—about any conduct you become aware of and believe may constitute a violation of European Union law (as defined in Article 2 of Law 2/2023, of February 20, governing the protection of persons who report regulatory violations and combat corruption).
Examples of such violations include:

  • Actions or omissions that may constitute a criminal offense or a serious or very serious administrative infraction.

  • Violations affecting the financial interests of the European Union (as set forth in Article 325 of the Treaty on the Functioning of the European Union).

  • Violations falling within the scope of the EU acts listed in the Annex to Directive (EU) 2019/1937 of the European Parliament and of the Council of October 23, 2019, on the protection of persons who report breaches of Union law, regardless of how they are classified under national legislation.

Through this Ethical Channel, you may also report to the Internal Reporting System Officer of Artá Capital any actions or omissions that may be considered criminal, irregular, unlawful, or contrary to the aforementioned regulations.

You may likewise exercise your data protection rights and report any breaches of data protection laws or security incidents.

The personal data you provide will be treated confidentially and securely safeguarded in accordance with appropriate security measures.
If you choose to remain anonymous, your identity will be concealed from the Internal Reporting System.
In such cases, the email address and phone number you provide will only be used as contact information to acknowledge receipt and update you on the progress of your report.

Please note that anonymity cannot be maintained if you exercise your rights of access, rectification, erasure, objection, restriction of processing, or data portability, as such communications must comply with applicable legal requirements.

Under no circumstances will information be disclosed to third parties other than those directly involved in the reported matter, except where required by competent investigative authorities.

Within a maximum of 7 days, you will be informed whether your report has been admitted or rejected for processing.
If admitted, a maximum period of 3 months is established to conduct the investigation from the date the report is received.
However, timeframes may vary depending on the nature and seriousness of the report, as well as the complexity of the investigation.
